SERVICE SPECIFICATION
Version 1.0 (Current)
Effective October 7, 2024
These Service Terms govern your use of the Services. Capitalized terms not defined here will have the meanings in the Terms & Conditions, Privacy Terms, Credit Terms, or other agreement you have with us governing your use of the Services (“Agreement”). If there is a conflict between the Service Terms and your Agreement, the Service Terms will control.
Match
The Service is accessible by Users using their access credentials via a website. The service allows to enter Input comprising a product description and selection of a set of patent documents. The product description may be entered as text or by uploading files comprising a textual or pictorial description of product features. The User defines the set of patent documents entering a search query and selecting patent documents.
The Service maps product features to features of the independent claims of the selected patent documents. Based on the ratio of relevant features a relevance score per patent document is returned. The Customer’s Credits are consumed based on the number of patent documents mapped to the product description. The number of patent documents refers to the number of patent documents the User selects in a request for matching with product documentation, and which is successfully mapped to the product documentation. For the avoidance of doubt, a mapping is considered to be successful if at least one independent claim with at least one claim feature was extracted from the document and the Patalyze Service searched in the Documents for matching product features. The mapping is considered to be successful, even if the Patalyze Service does eventually not identify any product feature matching any claim feature.
The Input will be processed as long as necessary for the performance of the Service (as described in Section 3.1.2 and 3.1.3 of the Terms & Conditions). Match processes all requests per Customer serially, even if the requests are sent from different Users. The Service can process requests more slowly or temporarily suspend the access to the Services on a case-by-case basis if the size of the Input (e.g. the Number of Documents, or file size of product description) significantly exceeds the normal and reasonable use and therefore the availability of the Services to all customers of Patalyze is affected.
In addition, browsers, their JavaScript execution environment, and the HTTP transmission techniques used impose technical limits. Patalyze will try to notify the User about exceeding these limits and warn about possible performance issues.
Ability to process Input is subject to the ability of the Service to correctly read and translate the Input, which can't be guaranteed. Requirements and limitations for Input:
