Service Specification

This Service Specification governs the use of the Services. Capitalized terms not defined here will have the meanings in the Terms and Conditions, Privacy Policy, Usage Terms, or other agreement you have with Patalyze governing the use of the Services (“Agreement”).

If there is a conflict between this Service Specification and your Agreement, this Service Specification will control, except that: (i) the deduction of charges from the AI & Data Usage Balance is governed by §9 of the Terms and Conditions; (ii) changes to Model Cost are governed by §9.6 of the Terms and Conditions; and (iii) changes to the Service Fee and the Data API Request Fee are governed by §9.6 of the Terms and Conditions. The amounts and rates published in this Service Specification are the current values; the mechanism for changing them is set by the Terms and Conditions.

1. Access to the Services#

The Services are accessible by Users (a) via a website using their access credentials, and (b) via Patalyze’s application programming interface (“API”) using API credentials (keys) issued to the Organization. All Services described below are available both via the website and via the API, unless otherwise stated. Organization is responsible for keeping website and API credentials secure and for all activity carried out under them, in accordance with §8 of the Terms and Conditions.

Organization shall not be allowed to access and control Services via the website through automated procedures, for example by scraping, circumvention of access controls, and use exceeding the published rate limits or fair-use limits. API access allows authorized automated access. Use of the API within those limits is permitted.

2. The Services#

2.1 Data API#

The Data API allows Users to query Patalyze’s Datasets by submitting a search query and to retrieve corresponding Records. Such Records may be used directly or imported into a Database for use with the AI-Generated Mappings Service (Section 2.2).

Each query executed against the Data API is one “Data API Request” and is charged at the Data API Request Fee (Section 3.4), deducted from the AI & Data Usage Balance as Data Usage.

2.2 AI-Generated Mappings#

The AI-Generated Mappings Service generates mappings between Records stored in a Database, for example mapping a product against a patent. A Database may contain Records of any object type, such as products, patents, scientific papers, technical standards, court and legal documents and Custom Objects. For each pairing the Service produces a structured mapping together with a mapping score indicating the overall degree of correspondence between the two Records; where a Record is a patent, the mapping score is derived from individual claim scores for each patent claim.

The AI-Generated Mappings Service is charged on a consumption basis as AI Usage (Section 3). Because the Model Cost is driven by the number and size of Records processed, the charge scales with the size of the Input and Output and is calculated only after processing.

The request is not charged where the request fails for reasons attributable to Patalyze, and charged where it fails due to unreadable or oversized Input.

2.3 Product Search Engine#

The Product Search Engine searches the web for products that fulfil search criteria defined by the User. Based on the User-defined criteria, the Service searches publicly available web sources, scrapes product information from those sources, and aggregates the product information that complies with the criteria into a structured result set (“Aggregated Product Information”). The Input is the User-defined search criteria; the Output is the Aggregated Product Information.

Aggregated Product Information may be used directly or as product documentation in the AI-Generated Mappings Service (Section 2.2).

Aggregated Product Information is compiled from third-party web sources that Patalyze does not control. It is provided on an “as is” and “as available” basis, may be incomplete, inaccurate, outdated, or duplicated, and Patalyze does not warrant the coverage, accuracy, timeliness, or completeness of any result (see §11 of the Terms and Conditions). The Organization is solely responsible for its use of the Aggregated Product Information, including ensuring that such use complies with applicable law and does not infringe the rights of any third party (§ 8.1.1 of the Terms and Conditions).

The Product Search Engine is charged on a consumption basis as AI Usage (Section 3). Because cost is driven by the breadth of the search and the volume of product information processed, the charge scales accordingly and is calculated only after processing.

2.4 AI Record Enrichment#

Patalyze’s AI enriches the data held on a Record, through AI Attribute Autofill and Feature Extraction.

Through AI Attribute Autofill, Users may add custom attributes (columns) to Records and have Patalyze’s AI fill in their values. The User defines the attribute (its name, type and an instruction describing the value sought); the Service reads the Record’s available data and writes the attribute’s value. Autofill may be run for a single Record or across many Records at once. The Input is the attribute definition and the Record’s existing data; the Output is the generated attribute value.

Through Feature Extraction, when product documentation is added, Patalyze’s AI extracts a structured set of features from it for use in the AI-Generated Mappings Service (Section 2.2). The Input is the product documentation; the Output is the extracted set of features.

AI Record Enrichment is charged on a consumption basis as AI Usage (Section 3) and is calculated only after processing.

2.5 AI Page Writing#

Patalyze’s AI generates the content of pages from the data held in a Database, across note, dashboard and table pages. For its guided analysis workflows, for example, Patalyze automatically generates a summary of a Database’s results, together with charts, and writes it into a note page. The Input is the data held in the Database; the Output is the generated page content.

AI Page Writing is charged on a consumption basis as AI Usage (Section 3) and is calculated only after processing.

2.6 Processing, fair use and suspension#

Patalyze may queue, batch, slow or limit the throughput of requests per Organization, including via the API rate limit in Section 4; processing is not guaranteed to be sequential or concurrent. The Service may process requests more slowly, or temporarily suspend access on a case-by-case basis, where the size of the Input (e.g., number of Records or file size of uploaded documentation) significantly exceeds normal and reasonable use and thereby affects availability of the Services to other Organizations. Organization may not retrieve more than 50,000 Records in line with §8.1.1(l) of the Terms and Conditions.

3. Pricing framework#

3.1 AI & Data Usage Balance and how charges are deducted#

Consumption-based Services are funded from the AI & Data Usage Balance held on the Organization’s account. For each request, Patalyze deducts the applicable charge after the request has been processed:

  • AI Usage (AI-Generated Mappings, Product Search Engine, AI Record Enrichment and AI Page Writing): AI Usage Charge = Model Cost × (1 + Service Fee).
  • Data Usage (Data API): the Data API Request Fee per Data API Request (Section 3.4).

3.2 Model Cost#

“Model Cost” is the charge incurred by Patalyze from the relevant third-party AI model provider(s) for processing a request: (Input Tokens × the provider’s then-current input rate) + (Output Tokens × the provider’s then-current output rate). Output Tokens include all tokens generated by the model, including reasoning/“thinking” tokens, which are billed at the provider’s output rate. The model rates are published on the pricing page.

3.3 Service Fee#

The AI Usage Charge includes a Service Fee, which is a 50% surcharge on Model Cost.

3.4 Data API Request Fee#

Each Data API Request is charged at a fixed fee of €0.075 net per request, deducted from the AI & Data Usage Balance as Data Usage.

4. Limitations#

  • Total storage per organization: subject to your plan’s storage limit (see the pricing page).
  • Number of patents per Database: subject to your plan’s limit (see the pricing page).
  • Number of products per Database: subject to your plan’s limit (see the pricing page).
  • Rate limits / fair use: API use is subject to a rate limit of 100 requests per minute and to the throughput and fair-use provisions in Section 2.6. Patalyze may throttle or temporarily suspend API access that exceeds these limits or that affects availability for other Organizations.
  • Data extraction: retrieving a substantial number of Records from the Datasets (more than 50,000) is restricted under §8.1.1(l) of the Terms and Conditions, including via the Data API.
